# Powerbeans Terms of Service: Key Points for Publishers

This page summarises the key points from Powerbeans' Terms and Conditions that every publisher should know before and during their use of the platform. ## Your responsibilities as a publisher
Using Powerbeans means you take on a set of responsibilities alongside the capabilities the platform provides. The key ones are:
* You are responsible for the content you publish — including ensuring it does not infringe third-party intellectual property, privacy, or other rights
* You must obtain all necessary rights, permissions, and consents for your content and any voice materials you submit for custom voice creation
* You are responsible for implementing a compliant Consent Management Platform (CMP) and providing accurate consent mechanisms for your readers — Powerbeans does not do this on your behalf
* You must not generate or distribute illegal, defamatory, hateful, deceptive, or otherwise prohibited content using Powerbeans tools
* You are responsible for preventing fraudulent, invalid, or incentivised ad traffic originating from your properties — Powerbeans may adjust, withhold, or claw back revenue attributable to invalid traffic
* Keep your API keys and embed codes secure — do not share them with unauthorised parties, use them on unauthorised domains, or sublicense access to the platform
## Content rights
You retain ownership of all Publisher Content — your articles, feeds, brand assets, and voice materials. Powerbeans does not acquire ownership by processing your content through the Services.
You grant Powerbeans a worldwide, non-exclusive, royalty-free licence to use your content to provide the Services — including ingesting, generating audio from, hosting, and streaming it on your properties.
This licence exists only to enable Powerbeans to operate the Services for you. It covers generating AI Outputs, caching and hosting audio and summaries, providing your analytics dashboard, and supporting troubleshooting and security.
## API, scripts and embed codes
Embed codes and API keys must only be used on your authorised domains. The following are strictly prohibited and may result in immediate access revocation:
* Reverse engineering, decompiling, or attempting to extract source code from Powerbeans software
* Using scripts or tags on domains not authorised in your Powerbeans account
* Sharing API keys, tokens, or embed codes with any unauthorised third party
* Using the Services to build or support a competing product
* Bypassing usage limits, plan limits, monetisation controls, or consent mechanisms
If Powerbeans detects misuse, it may rotate, revoke, or suspend your API keys and restrict access to the platform without prior notice.
## AI-generated content
Powerbeans uses AI to generate audio narration, text summaries, playlists, and related outputs from your articles. Before publishing, be aware of the following:
Audio and summaries may include inaccuracies, mispronunciations, outdated information, hallucinations, formatting issues, or inappropriate categorisation. These are inherent to AI generation and are not guaranteed to be caught automatically.
You are responsible for deciding whether, when, and how to publish AI outputs. If your editorial standards require review before publication, build that into your workflow — Powerbeans does not validate outputs against your editorial policies.
Powerbeans may regenerate, update, replace, version, disable, or remove AI outputs as needed to provide or improve the Services, resolve errors, address legal concerns, or comply with third-party requirements.
## Service availability
Powerbeans uses reasonable skill and care to provide the Services, but cannot guarantee 100% uptime or uninterrupted availability.
* **Maintenance and updates** — planned maintenance, security fixes, and infrastructure changes may occasionally affect availability. Powerbeans will seek to minimise material disruption where practicable.
* **Feature changes** — Powerbeans may modify, add, remove, or replace features for product development, security, legal compliance, or third-party reasons.
* **Beta features** — any features marked as beta, preview, or early access are provided as-is and may be changed or withdrawn at any time. Do not rely on them for critical production workflows.
* **Third-party dependencies** — the Services depend on providers such as AI generation APIs, ad demand partners, and cloud infrastructure. Powerbeans is not responsible for failures or policy changes from those third parties.
## Liability limits
Powerbeans' total aggregate liability to you is capped at the greater of: **(a)** the Fees you paid in the 12 months before the event giving rise to the claim, or **(b)** £100. Neither party is liable for indirect or consequential losses — including loss of profit, revenue, business, data, or anticipated savings. These limits apply whether the claim arises in contract, tort, or otherwise. Full details are in clause 24 of the Terms.
## Termination and data deletion
You can cancel your subscription at any time from your Powerbeans dashboard. Cancellation takes effect at the **end of the current billing period** — you retain full access until that date. After cancellation, your widgets will stop serving content.
After your agreement ends:
* **Publisher content and AI outputs** — deleted or anonymised within **90 days**
* **Billing and account records** — retained for **6 years** for tax and legal compliance
* **Technical logs** — deleted within **6 months**
These timelines are the same regardless of plan, and are also governed by the DPA for any personal data within your content.
If you are on an Enterprise plan, you can request an export of your audio files and text summaries before termination. Send your request to [legal@powerbeans.ai](mailto:legal@powerbeans.ai) — Powerbeans will provide the export within one month of receiving the request.
## Governing law
These Terms and any dispute arising from them are governed by the **laws of England and Wales**. The courts of England and Wales have exclusive jurisdiction over any dispute or claim, including non-contractual disputes.
